After five years of marriage, actress Katie Holmes has filed for divorce from couch jumping husband Tom Cruise.  People magazine broke the news this afternoon, stating that Holmes filed for irreconcilable differences.  Of course the jokes about that rumored marriage contract came up once again in full force, causing a flurry of tweets all over Twitter.  Holmes, according to ABC Night News with Diane Sawyer, will be seeking full custody of the couple’s daughter Suri.

Kate’s attorney released a statement saying, “Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy.”

According to ABC News, Tom Cruise was blind-sided by this divorce filing from Katie.  Apparently, he doesn’t even have a divorce attorney hired.  Well Tom, we hope you call whomever handled your last two, because we double you’ll be losing Suri without a fight.
